OLD LYME ZONING COMMISSION
PUBLIC HEARING
Monday, December 9, 2013

The Old Lyme Zoning Commission held a Public Hearing on Monday, December 9, 2013, at 7:30 p.m. in the Auditorium of Memorial Town Hall.  Those present were:  Jane Cable, Chair, John Johnson, Vice Chairman, Jane Marsh, Secretary, Tom Risom, regular member and Pat Looney, regular member.

Also present were Ted Kiritsis, alternate, Joan Bozek, Alternate (arrived at 7:35), Harland Frazier, Alternate and Ann Brown, Zoning Enforcement Officer.

Chairman Cable called the Public Hearing to order at 7:32 p.m.

1.      Special Permit Application to permit a master suite addition to the first floor of an existing structure on a nonconforming lot (8,000 s.f.) in accordance with Section 9.1.3.2 of the Zoning Regulations on property located at 33 Brightwater Road, Paul Graml, owner/applicant.  

Jane Marsh read the legal notice as published in the New London Day.

Jeff Flower, Architect, was present to represent Mr. and Mrs. Graml, who were also in attendance.  He presented the proof of mailing, noting that one was returned as the abutter had moved to Florida.

Ms. Marsh read the list of exhibits for the record.

Mr. Flower explained that the applicants would like to put an addition on their home.  He presented an updated site plan, with revisions 11-7-13; he noted that the building line is shown as 30’ and should be 25’ (front setback).  Mr. Flower stated that the addition is a one story master bedroom addition.  He noted that the deck is new and is counted toward coverage.  Mr. Flower stated that the existing first floor is 644 square feet and the addition brings it to 1,019 square feet.  He explained that the existing coverage is 17.5 percent and it is being increased to 23 percent; the floor ratio is increasing from 20.3 to 25 percent.  Mr. Flower noted that the addition meets all the Zoning Regulations, including setbacks.  He reviewed the site plan, pointing out the location of the new septic system.

Mr. Looney questioned whether there were any exceptions to the health code.  Mr. Flower noted that there is one distance that will remain as it was, but is slightly less than code.  Mr. Looney stated that one of the requirements is that there be no exceptions.  Ms. Brown stated that the Sanitarian was not in today so they were not able to get clarification from her.  Mr. Flower stated that the regulation further states “or will not have any effect on the project.”  Ms. Brown read the regulation.  

Mr. Flower presented and explained the elevation drawings, along with photographs of the existing structure.  

Mr. Kiritsis noted that the existing house does not meet the side setback.  Ms. Brown reminded the Commission that the front setback is drawn incorrectly at 30 feet and should be drawn at 25 feet.  Mr. Flower noted that when they file the plan that setback line will be corrected.  He noted that the new addition is 1’ behind the 25’ setback.  Mr. Flower indicated that the patio is 14’6” to the rear property line and indicated that he will modify that to 15 feet.

No one present spoke in favor of or against the application.  Hearing no further comments, Chairman Cable asked for a motion to close the Public Hearing.

A motion was made by Pat Looney, seconded by John Johnson and voted unanimously to close the Public Hearing on the Special Permit Application to permit a master suite addition on property located at 33 Brightwater Road, Paul Graml, owner/applicant.

Chairman Cable adjourned the Public Hearing at 7:56 p.m.
